By accessing or using PrepTraining ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and PrepTraining regarding your use of the Service.

PrepTraining is a gamified disaster preparedness platform that helps users improve their preparedness posture through:

• Daily habit tracking and micro-tasks
• Interactive emergency scenarios and simulations
• Progress tracking with collectibles and badges
• Personalized recommendations based on user assessments

AI-Generated Content Disclosure

Some content within the Service, including quiz questions and scenario narratives, may be generated using artificial intelligence based on established disaster preparedness guidelines. This content is reviewed for accuracy but should not replace professional emergency preparedness advice.

Educational Purpose

The Service is provided for educational and informational purposes only. It is not a substitute for professional emergency management advice, government guidance, or official emergency services.

Eligibility

You must be at least 16 years old to create an account and use the Service. By creating an account, you represent that you meet this age requirement.

Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Account Information

You agree to provide accurate and complete information when creating your account and to keep this information updated.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission

Payment

Premium membership is available as a one-time purchase. Payment is processed securely through Stripe.

Features

Premium membership provides access to additional features including unlimited daily tasks and scenarios. Specific features may change over time as we improve the Service.

Refunds

Premium purchases are generally non-refundable. However, we may consider refund requests within 14 days of purchase on a case-by-case basis. Contact support@preptraining.com for assistance.

Our Content

The Service and its original content, features, and functionality are owned by PrepTraining and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you submit through the Service (such as notes or feedback). By submitting content, you grant us a non-exclusive license to use it for providing and improving the Service.

Third-Party Content

The Service may include content derived from publicly available disaster preparedness resources. We attribute sources where appropriate and do not claim ownership of such content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted or error-free
• The Service will meet your specific requirements
• The information provided will be complete or accurate
• Following the preparedness guidance will guarantee safety in emergencies

Emergency Disclaimer: PrepTraining is an educational tool. In actual emergencies, always follow guidance from official emergency services and government authorities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREPTRAINING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any content obtained through the Service
• Damages resulting from unauthorized access to your account

Our total liability for any claims under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

You agree to indemnify and hold harmless PrepTraining and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity

By You

You may terminate your account at any time through the Data & Privacy settings in your account. Upon termination, your data will be deleted in accordance with our Privacy Policy.

By Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct we determine to be harmful to the Service or other users.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. Premium purchases are non-refundable upon termination for cause.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice on the Service
• Requesting re-acceptance of the updated Terms
• Sending an email for significant changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

For EU consumers: This choice of law does not deprive you of the protection afforded by mandatory consumer protection laws in your country of residence.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
